Michael Jackson’s ‘distracting’ inner circle can't testify August 30, 2011 | 9:05 am
A Los Angeles County Superior Court judge excluded the testimony of more than a dozen defense witnesses in the trial of Michael Jackson's doctor, saying that they would confuse jurors and distract from the case.
Los Angeles County Superior Court Judge Michael Pastor excluded the testimony of Jackson's longtime dermatologist, his business manager and the nanny of his three children.
The defense had hoped the testimony of these confidants and other insiders would convince a jury that the singer was so drug-addled and experiencing so much pressure to perform that he accidentally overdosed on a surgical anesthetic.
"Discussions of these subject matters are sufficiently convoluted, distracting and detracting as to substantially outweigh any probative value whatsoever," Pastor said.
The judge also prohibited any witnesses connected to Jackson's 2005 prosecution for child molestation. Defense attorneys for Conrad Murray, Jackson's physician who was at the pop star's home when he overdosed, said they wanted to call a Santa Barbara County sheriff's detective who found propofol and Demerol in the performer's Neverland estate in 2003. A jury acquitted Jackson of all charges.
"That is no-go territory as far as this criminal trial," Pastor said.
A lawyer for Murray said the defense planned to file a motion later this week asking the judge to reconsider.
"A large point of our defense has been gutted," lawyer Edward Chernoff said, "but if we have to go to a tank battle with a switchblade, that is exactly what we'll do."
Prosecutors contend that Murray, hired as Jackson's $150,000-a-month concert doctor, bears criminal responsibility for his death. They have said he injected Jackson with a drug, propofol, that should never be used outside a surgical setting and then left him unattended. Prosecutors urged the judge Monday to keep testimony focused on the medical care Murray provided the singer before his June 25, 2009, death and not Jackson's mental state or drug use.
"The People are very concerned about this trial deteriorating into an attack on Michael Jackson," Deputy Dist. Atty. David Walgren said.
Jury selection in Murray's trial begins Sept. 8, with testimony starting at the end of the month. The trial is expected to last five weeks.

Tom Mesereau - who defended late singer Michael Jackson in his 2005 child molestation case - thinks it is right his personal physician Dr. Conrad Murray is to be prosecuted over the star's death so his family can move on.
Dr. Conrad Murray "should be" prosecuted over the death of Michael Jackson so his family can move on, the singer's former defence lawyer Tom Mesereau has claimed.
Mesereau - who defended the late pop legend in his 2005 child molestation case, which ended with Michael being acquitted of all charges - believes the physician should face punishment if the accusation of involuntary manslaughter caused by a Propofol anaesthetic overdose is true.
He exclusively told BANG Showbiz: "I have mixed feelings about the trial. On the one hand I'd like to see the Jackson family get justice, I think what the doctor allegedly did was outrageous and based on everything I've heard he acted very recklessly, very foolishly and should have stood up to whoever he had to stand up to and say, 'This is dangerous, this doesn't belong in the home, we don't have proper equipment and we don't have proper help.' That's the way he should have behaved as a medical professional...
"I think he should be prosecuted to help vindicate the family and also to send a message that physicians should not behave this way."
Although he wants to see justice done, Mesereau is not looking forward to Murray's defence lawyers trying to destroy his former client's reputation when the trial starts on September 8.
He added: "I suspect the defence is going to try and dirty up Michael's reputation and I don't look forward to that at all. I don't look forward to seeing autopsy pictures and things like that ... I'm glad the District Attorney's office is prosecuting him, but my concerns are the defence lawyers are going to try to devalue Michael and try and throw a lot of dirt at the wall and see what sticks."
Mesereau appears in David Gest's upcoming documentary 'Michael Jackson: The Life of an Icon' - which contains interviews with more than 50 of the King of Pop's closest friends and family members - and he speaks in detail about the 2005 trial.
The 61-year-old attorney insists the film, which is being released on DVD on October 31, is a wonderful tribute to Jackson - who died in June 2009.
He said: "It's a beautiful documentary it's very original, it's very sensitive and it has a number of interviews with some of the old Motown greats about what this child prodigy was like. I haven't seen any other documentary that does it as well as David Gest's documentary. It's beautiful, it's sensitive, it's informative and I think everyone should see it."

August 29th, 2011 No family, no Murray.
Motion in Limine regarding proposed Defense Witnesses Prosecution asked for the elimination of any Santa Barbara (2005 trial) allegations of investigation references. They were concerned that it was a cheap shot at an obvious Character Assassination and an attempt to inflame the Jury. The allegations and investigations have nothing to do with the negligent medical care provided by Murray. Therefore the Defense’s witnesses related to these matters should be eliminated from the list (including any other unknown witnesses): Steve Robel, Chris Carter, Gerald Labiner, Barney Vanvalin, Michael LePerruque.
Defense claimed that past drug addictions, use, desire and possession was of the matter because they believe Michael self-ingested the Propofol and was so obsessed with it and was going off Demerol at the time of his death and therefor any past drug use and course of conduct over decades is relevant.
Prosecution answered by stating that the Toxicology findings showed that there was NO Demerol in Michael’s system and that this was an attempt to confuse the Jury. Furthermore, they weren’t given any Discovery from the Defense regarding supposed findings from 2003-2005. Prosecution argued that only what is relevant to 2009 should be addressed in court and this was another attempt to attack the victim unfairly.
Defense replied by saying that Demerol addiction and withdrawal was relevant because it causes insomnia and that Murray didn’t know that Dr. Klein was giving him some in his office.
Judge’s ruling: The Prosecution’s motion to In Limine Proposed Defense Witnesses is GRANTED.
Anything that has to do with the 2003-2005 is fundamentally irrelevant! All witnesses mentioned above are excluded and will NOT be allowed to take the stand in this trial. The Judge said that discussions in the matter are misleading and unfair, prejudiced, distracting and irrelevant and call for a complete exclusion.
Next on the In Limine Proposed Defense Witnesses:
Allen Metzger
Defense claimed that his testimony as an ex health care provider would be of importance and show that Michael supposedly asked to be intravenously injected with sleep medicine.
Prosecution answered back by asking the Defense to give proof of this claim.
Judge then asked the Defense if Metzger ever prescribed anything to Michael.
Defense’s answer:” NO, but if Michael would have gotten Propofol on April 18th, 2009 (last time he saw Metzger) then he would not have needed Murray to give him any”.
Judge’s ruling on Metzger: Metzger is allowed to testify.
Allen Adams
Prosecution’s argument for Adams: He claimed that Michael used Propofol in July 2008 and that Adams is a dentist that did 4 dental procedures on him which took place in a medical office with an anesthesiologist present and never out of a medical setting like a bedroom.
Defense’s argument for Adams: Adam’s medical records clearly contradict what he told the Police. His activities are relevant. April 2009 was the last time Adams saw Michael and the time where Murray supposedly let Adams put Michael to sleep.
Prosecution came back with the argument that this was only Murray’s claim, and that all other Adams ‘ medical occasions relate to 2008 dentist procedures and are irrelevant to the case.
Judge’s ruling: Allen Adams is allowed to testify.
Cherylin Lee
Judge’s ruling: CherylinLee is allowed to testify.
Arnold Klein
Prosecution objected to Klein because he gave Michael Demerol for dermatology procedures and that it was an attempt from the Defense to put the focus on Klein’s actions instead of Murray’s. However, the Prosecution does not object to having Klein’s medical records admitted in court.
Defense responded by arguing that the use of powerful drugs is relevant and that they may not call Klein to the stand but his testimony might be wanted independently from the medical records.
Judge’s ruling: Kleinis not allowed to testify. Irrelevant since there is no objection to the use of the medical records.
Ellen Brunn and Jason Pfeiffer
Prosecution argues that these two witnesses (who worked in Klein’s office) should be excluded for the same reason as Klein.
Judge’s ruling: Brunn and Pfeiffer are not allowed to testify.
Prosecution objected to Etok testifying because of the Defense’s claim that she refused to give Michael Propofol. This witness cannot be taken seriously because she is not a medical doctor! She has a PHD in engineering and not in medicine!
Defense answered that this should show Michael’s desperation in asking Etok for Propofol and that Michael asked her because her aunt is an anesthesiologist.
Judge’s ruling: SusanEtok is not allowed to testify.
Karen Faye
Prosecution claimed that the Defense want to put Karen Faye on to say that he was weak and thin a week prior to his death. Prosecution claimed that this was only her opinion.
Judge’s ruling: Karen Faye is allowed to testify.
Travis Payne
Prosecution stated that they had no discovery what so ever regarding Payne.
Defense argued back that the footage they all watched from This Is It clearly shows Paynepresent and that therefor is circumstantial evidence that he had knowledge on Michael’s health and state of mind and that Paynewould most likely testify that Michael was unwell.
Judge’s ruling: Deferred Decision.
Grace Rwaramba
Prosecution stated that despite the Defense’s claims that Rwaramba might have witnessed drug use since 1992 she was actually fired in April 2009 and wasn’t even at the house when he died.
Defense argued that her testimony would be relevant because of her history and what she would have witnessed.
Judge’s ruling: Grace Rwaramba is not allowed to testify.
Thome Thome
Prosecution claimed that the Defense only believes that Thome might have certain claims to make and that Thome should not testify as all he did was negotiate the This Is It contract with AEG and nothing else.
Defense argued that Thome is extremely important because of his negotiations with AEG and would reveal Michael’s mental state because of the concerts.
Judge’s ruling: Thomeis not allowed to testify. His testimony would be potential for distraction. The Judge further quashed any subpoenas that were being held so far.
Stephen Pustilnik (Medical Examiner)
Prosecution said that Pustilnik’s testimony only comments on his opinion of the Coroner’s office facility which he visited 2 years after the autopsy, and not on any toxicology findings. His testimony is therefore totally irrelevant.
Defense responded by saying that Pustilnik was present during the autopsy and a witness to the coroner’s findings and that he has a different opinion to the coroner’s investigation findings.
Judge’s ruling: Deferred decision until after the Jury is sworn in.
Michael Lee Bush
Judge’s ruling: Subject to revisiting.

It's very interesting to see all the names that have been excluded from giving testimony. Also interesting is the fact that some names are being deferred as possible witnesses until after the jury has been selected and sworn in.

Judge Michael Pastor has been assigned to handle all proceedings in the Conrad Murray matter.
Over the years Judge Pastor has handled a significant number of very serious and complicated felony matters, including charges of multiple murder, sex offenses, and fraud.
He is one of only 10 judges on the entire L.A. Superior Court who is designated to handle "Complex Criminal Litigation/Long-Cause" criminal matters.
He recently completed a court trial involving charges of stalking and burglary; the alleged victim Shawn Johnson, who won both the Gold Medal in gymnastics for the U.S.A. in the Beijing Olympics and the competition in the television program "Dancing With The Stars." This case was handled as a court trial without a jury for both the guilt and sanity phases of that matter.
In addition, Judge Pastor heard the case with defendant-actor Jason Priestley accused of driving under the influence of alcohol causing bodily injury to his passenger.
Judge Pastor was assigned to handle a case involving a photographer charged with perjury, attempted grand theft, and forgery; the alleged victim, actress Cameron Diaz.
Judge Michael E. Pastor was born in New York City and grew up in Buffalo, where he attended high school. He graduated from Cornell University in 1971 and worked in New York City for a year before beginning law school.
Judge Pastor attended U.S.C. Law School and graduated in 1975. He then handled criminal defense matters before and after passing the California Bar in 1975. In 1976, Judge Pastor was hired by the Los Angeles City Attorney as a deputy and served as a prosecutor at the Metro, CCB, and Van Nuys branches of that office. In addition to his duties as a criminal litigator, he wrote manuals used by prosecutors. He developed the Chronic Offender Prosecution Emphasis (COPE) unit of the office and worked with the newly-formed “Mothers Against Drunk Drivers” (MADD) to devote resources toward the prosecution of alleged recidivist DUI offenders. Judge Pastor was selected as Assistant Supervisor and then as Supervisor of the Van Nuys branch and as Acting Head of Branch Operations.
Judge Pastor was appointed to the Los Angeles Municipal Court in January 1983 and managed misdemeanor trials, the master calendar, and preliminary hearings at the Metro Branch; and in the following year, he was appointed the Supervising Judge of that branch. In 1985, he was assigned to the Criminal Courts Building, where he handled misdemeanor trails, E.D.P. matters, and preliminary hearings. He became the first judge in Los Angeles County to handle “Night Court” preliminary hearings.
In 2000, Judge Pastor was elevated to the Los Angeles Superior Court as a result of court consolidation. From 2000 to 2001, he served as the Assistant Supervising Judge of the Criminal Courts-Central Division. In 2001, Judge Pastor was assigned to handle felony jury trials in the Foltz Criminal Justice Center and remained in that assignment until 2004, when he was chosen for his present assignment in a felony “complex criminal litigation” courtroom on the 9th floor of the CJC. In that capacity, he has presided over a significant number of complicated and noteworthy criminal proceedings.
Throughout his legal career, Judge Pastor has lectured on and taught a variety of topics relating to criminal law, criminal procedure, and evidence.
In 2007, the Los Angeles County Bar Association-Criminal Justice Section honored Judge Pastor as “Judge of the Year.”
In 2010, the Los Angeles Criminal Courts Bar Association honored Judge Pastor with its “Judicial Excellence Award.”

Los Angeles - There was no action in court in the Conrad Murray case on Tuesday, but behind the scenes both sides were going through questionnaires... trying to figure out who the best jurors will be. Hal Eisner who has been covering the case had a discussion on the jury questionnaire with FOX 11 News' legal analysts, Winston McKesson, Paul Geller, and Steve Levine.

Bizarre -- a pharmacist who testified he shipped MASSIVE amounts of Propofol to Dr. Conrad Murray in the weeks leading to Michael Jackson's death has disappeared without a trace, prosecutors claim.
According to prosecutors, Tim Lopez -- a former pharmacist at Applied Pharmacy Services in Las Vegas -- has mysteriously moved to Thailand and cannot be found.
Prosecutors now want a judge to let them use Lopez' previous testimony from the preliminary hearing in January -- when he claimed Dr. Murray ordered several large quantities of Propofol, beginning on April 6, 2009.
Two hearings have been set for next week to decide if the testimony will be permitted.

When Michael was on trial in 2005 we were not allowed to make any noise inside the courtroom or to wave to him when he walked by (which was very hard and he broke the rules every once in a while too ;-) but we were allowed to stare /look at everyone we wanted for as long as we wanted! What a strange rule now!

Remember you are the voice of Michael now! We don’t want the press saying the fans don’t care and don’t show up, especially on the first day of court. The family needs you out in numbers really really badly. I also know that a lot of you can’t make it and I feel you will be there in spirit. I understand that. Please try to come out with your signs. Even though it has been over two years, let’s show the world that Michael’s legacy and fans still support him no matter what! Let’s work together and make a strong showing on the 27th at the courthouse. Delaying the trial the way they did was a ploy to make it hard for you to come and divide you, but let the court and the world know that you are loyal and can never be divided, no matter what! And remember, most of the stuff that you hear in the press about the family is not true. Once again this is a ploy to divide and conquer. I only send out a letter when feel it is very very important. Michael Jackson's eldest son Prince-- an eyewitness to the horrific scene in the bedroom where his father lost his life -- does not want to testify in the Conrad Murray trial, but he's telling family he'll do what needs to be done to get justice for his departed dad.
Sources close to Prince tell TMZ ... the 14-year-old is "nervous" and worried that if he's called to the stand he might get flustered and "mess up."
We're told if Prince is called by prosecutors ... Katherine will ask her lawyers to request that the entire courtroom be cleared during his testimony. Judge Michael Pastor almost certainly will prohibit the media from training a camera on Prince, but it's unlikely he'll clear the courtroom.
As we previously reported, Prince is on the prosecution's witness list, since Dr. Murray summoned Prince to the bedroom for help during the emergency. When Prince arrived, he dissolved into tears.
The trial starts today. We'll be livestreaming opening statements.
I can say I have finally caught up to all of the latest posts with the exceptions of the videos posted on this page above. But I will today if all goes well.

I couldn't believe my ears when they played the slurred audio of Michael. I can't imagine the pain Michael's family are going through right now during that time.
The defense's opening shows a lot of inconsistencies...so that don't make sense.
Murray deceived the paramedics and the drs!

Michael Jackson's personal assistantMichael Amir Williams just took the stand -- and prosecutors played a panicked voicemailDr. Conrad Murray left on Williams' phone the day MJ died.
* Williams said MJ was in good spirits on the evening of June 24, 2009... his last rehearsal. He said the rehearsal was "amazing."
* The following day, Williams received a panicked message from Murray at 12:13 pm saying, "call me right away." When he called back, Murray told him MJ had a "bad reaction" ... and to "get somebody here immediately."
* When he got there, the first thing he saw was MJ being brought out in a gurney. He said Murray seemed "frantic."
* Williams said after he learned of Michael's death, Murray came up to him and said there was "some cream Michael wouldn't want the world to know about." Murray asked him to drive him to the home so he could retrieve the "cream."
* After checking with MJ's head of security, Faheem Muhammad, the two decided not to let Murray back into the house...
* Williams said it was "normal" to have oxygen tanks in MJ's house.
* Williams told Ed Chernoff he never told police about Murray's odd request until two months after Michael's death.
* Williams told Chernoff Dr. Murray never asked him to call 9-1-1.
In his contract with concert promoter AEG, Dr. Conrad Murray asked for a bunch of medical items: a gurney, saline, catheters and a portable CPR device. That last item has some raised some questions.
Tuesday on the stand, attorney Kathy Jorrie, who drew up Dr. Murray's contract with Jackson for AEG, explained to the court why Murray said he needed the machine.
I will share video and photos when I have assembled them. I spent yesterday outside the court house, all day, with a one hour break for lunch, but I decided to be outside to face the media and carry my own hand made sign with my thoughts. The lady interviewed in this video was standing opposite me yesterday. She came from Spain. Two other ladies I stood next to came from Denmark and France - to be here to support Michael and his family and to see justice carried out. I am amazed and moved by the tremendous loyalty of many of Michael's fans around the world.

I hope you all are well. I have been watching and reading about the trial on here (Bonnie Vent site). I feel sick by all the new information I am hearing from the witnesses, which makes it difficult for me to get my thoughts together and coherently type anything.
Additionally, I want to thank you Bonnie for collecting all this pertinent information on Murray's trial and placing the information in one place for us to make better sense of the facts in this case.
It is still hard this morning to put my thought to words, but after a night of re-coop…here goes.
Firstly, the trial testimony information that worries me the most right now is the fact that Alvert and paramedic Senneff differed in their testimony and one of them has to be not telling the truth.
The following is from page 2 & 3 of a five page article:
“The defense appeared to make one important point in their cross-examination of Senneff. The paramedic said when he first walked into the bedroom he saw Murray and a security guard moving Jackson off the bed and onto the floor.

The timing is important because it could call into question testimony by Alvarez about when Murray asked for his help in collecting drug vials from around the bed.”
I am praying for Michael and his family. The testimony so far indicates to me that he should have been charged with second degree Murder…not manslaughter.
Also, I was wondering if the Doctor testified about briefly restarting Michael’s heart? I had read online (over a year ago) that the Doctor in the ER restarted his heart for a short time.
The paramedics never did get a pulse or heartbeat. They tried 3 rounds of what they call a start kit (designed to start the heart) to no avail. The paramedics were in contact with the hospital. The hospital staff were prepared to call a time of death. Dr. Murray insisted Michael be transported and the paramedics complied. They were using emergency procedures in the ambulance as well. They still had no pulse or heartbeat. The paramedics also reported Michael's skin was cool to the touch and starting to turn a blue color. The ER doctor and her team never got a pulse or heartbeat either, but they did perform all the required procedures. The paramedics were asked if they felt that Michael was already dead when they arrived at the Carolwood house and they said yes.

Hi all, In case you don't already know, JOHN BRANCA will be interviewed tonight by Piers(sp?)Morgan on CNN @ 6:00 pm & 9:00 PST. I was stunned to hear this; but then again, I shouldn't be surprised. Although I heard it from another room, what I can remember hearing was just that Michael Jackson's close friend & Estate Manager, John Branca and Deepak Chopra on Monday night.

Thank you Bonnie for all the updates and being here for Michael all the time. Thank you Chaturie for bringing us the Piers Morgan interview to awareness. I could not watch it on CNN Europe. Usually they air his show. Perhaps they´ll do it today though I must say that - I do not know how you feel but - it makes me sick to just see those conspirators and liars Branca and Weitzman. They are ice - coldly lying into the camera and promoting their after murder business to generate more and more money. And they are playing on the fans, make them look good guys to keep the money coming in in mostly their pockets, not the estate´s. Of that I am sure having learned a lot about and from Michael himself. You can write a lot on fake papers and speak a lot of anything into the camera feeling sure because you live in the phantasie of having powerful people behind you. This is so far the case. But nothing on this planet has ever lasted eternally...besides God´s Truth - and the whole truth about the conspiracy that led to Michael´s murder will take its path to come out - like it or not..... You may be able to deceive the world for still a tiny bit of time but NOT US ! "Deceive - Inveigle - Obfuscate..." - sounds familiar? You should know it. Hi Ute, I could add nothing to what you have said here about Branca & Weitzman. I feel exactly as you do. I only mentioned the interview here to let people know they are definitely out there doing their spin, showing up as the wonderful 'good' guys Michael was surrounded by. I felt compelled to watch it just to see how they went about it, and it was as I expected.
By the way, did you notice that Prince Michael was accompanied by Dieter Wiesner in Berlin when he was signing autographs? I thought of you when I saw him.
The jury only heard half of Dr. Conrad Murray's dramatic 2-hour interview with police today -- in which Murray admitted he pumped Michael Jackson full of sedatives before he died -- and now, here's the other half ... you have to read it to believe it.
Among the highlights ...
-- Murray details an emotional encounter with Katherine Jackson just moments after she hears the news -- she asks him if he knows how Michael died. Murray says he doesn't.
-- Murray claimsJoe Jackson never showed up at the hospital the day MJ died.
-- And ... Murray explains why security cameras caught him exiting the hospital at 4:30PM.
The jury will hear the remainder of the recording when the trial resumes on Tuesday.

Note from Bonnie Vent: My apologies to those that are offended by this photo. It is a part of the case. It speaks to the question of was Michael healthy or as some have reported emaciated. He is thin but according to the autopsy report he is within normal range. This is what Michael told me as well. The date "mistake" is also very interesting since Michael came through to me at the Roosevelt Hotel on 08/25/09. There also seem to be some sort of disturbance in the court today. The judge said it was overhead and looked up. The judge had a very strange look on his face. Perhaps Michael decided to make an appearance. If a living person had caused this I have no doubt the judge would be quick to point it out and end it. We saw this on Friday when Jackson family members decided to leave while the court was in session.

The date on the tiles beside his body reads August 25th, 2009 -- but the autopsy doctor Christopher Rogers claims the date is wrong ... it should read June 25th.
The doctor who declared Michael Jackson's death a homicide claims it's extremely unlikely the singer killed himself with a deadly dose of Propofol -- insisting Dr. Conrad Murray is more likely to blame.
Dr. Christopher Rogers just testified -- Murray's description of the final moments leading up to Michael's cardiac arrest just doesn't add up.
Murray claims he left for two minutes to go to the bathroom -- and when he returned, Michael wasn't breathing. The defense will argue MJ self-administered a deadly dose of Propofol in that time.
But Rogers insists ... Murray's scenario is nearly impossible -- because in that two minute window, MJ would have had to wake up (under the influence of several powerful sedatives) and skillfully administer the deadly dose ... which would then have had to travel to his brain, causing him to stop breathing.
What's more likely, according to Rogers -- Murray administered several doses of Propofol in the hours leading to Michael's death without properly measuring them out ... resulting in an overdose.
Hi Bonnie, I feel that there is definitely something significant attached to this date anomaly. Dr.Rogers seemed very surprised by it. He conceded to the date on the photo. But one could see that he was reluctant to do so.
